Legal Question in Real Estate Law in New York

Can I be forced to sell?

Can I be forced to sell my home if the deed is my name and the name of my friend? My friend and I are not married, we are splitting up. We are listed on the deed as joint tenants. The mortgage and the the equity line of credit are in my name alone. The payments for both are and have been current. I have my two minor children living with me, his 2 live with his ex wife. He says he will force me to sell the house and make me and the girls leave. Can he do that?

Re: Can I be forced to sell?

He can if he goes to court to force a sale. This will requrie legal action which will require a lawyer on his part (and then yours). The process is not cheap so maybe that will be a deterent to him.

Good Luck

You should contact an attorney as soon as possible. You may be able to negotiate a buyout before litigating. There are probably several other things you can do to better your position in the meantime.
