Legal Question in Real Estate Law in New York

Hi,

I was wondering if it is possible to sue an apartment complex for inappropriate behavior of one of their managers who sold their apartments. For example, the apartment manager in my father's apartment complex was witnessed having personal items (laundry) in his apartment along with dining and drinking wine in there. My father only lived in the apartment during the week to avoid a 3 hour commute home every day. After a year, he confessed to my mom that he had an affair with this manager. They are now in the process of getting a divorce and my mom and us kids have suffered greatly from this. The woman has also admitted to my mother that she had an affair with him. Is it possible that her behavior allows for a case against the apartment complex?

I do not think so. Actions by the apartment manager were consented to by your father.
