Legal Question in Real Estate Law in New York

My Home.

Question:I had moved out of my mothers house about 2.5 years ago. for no reason other then i wanted to go live with my signifiant other. My question to you is since my mothers house is soley in her name and my 21 year old brother lives there does he have the right leaglly to throw me out of the house? The reason is becasue him and i dont get along and havent ever since i moved out. My mother wants me over there and DOES NOT have a problem with me being there but he does. DOes he have the right legally to kick me out.

As long as the house remains solely in your mother's name and she continues to want you to visit, you should have no problem. Your concern is what happens if anything happens to your mother, major illness or her passing away. What will she do with the house? If she leaves it to your brother only, or puts his name on the Deed if she were to get ill, you could have a problem. I suggest talking to her about this, express your concern and see what she thinks.
