Legal Question in Real Estate Law in New York
Is a Homeowner in Pre-Forclosure, who is not presently living in the residence, still responsible to maintain the property (ie. above ground swimming pool.) Can the town sue or impose fines on the homeowner? Township of Islip, Suffolk County, N.Y.
Thank you,
Just a concerned neighbor

The h/o is responsible until the final sale which, out here, takes years. "Pre-Foreclosure" encompasses a LOT of time in Suffolk and a lot of steps. The town could step in and clean up, and tack on a bill, but good luck getting blood from a stone.
