Legal Question in Real Estate Law in New York

homeowners association

We own a seasonal cabin that is part of an association. These cabins were built and sold as part of a sub division over 25 years ago. An association was formed with a board of directors to manage and maintain the roads and common area including a pond for swimming, a picnic and recreation area. There is an easement on the individual properies to provide for a road and allow access to all owners. We pay $160 per year per cabin owner to maintain the roads and insure the property. There are 50 cabin owners and only 43 are paying.

Our problem is, each owner is ''not required'' to pay. How can we get something attached to the indivual deeds to make this a requirement. We would be willing to grandfather in those who are not paying?

Check your HOA documents. The Board should be able to amend to add such a provision. Good luck.
