House Name Change
My father who recently passed away owns a house in Yonkers. The house is in his name. My mother died 4 years ago and my only brother died 12 years ago. Both parents will list me as the executor, but the only estate there is is the house. How do I go about making changing the owner name on the house to mine? - And what would be the estimated cost to do that?

You don't necessarily need to probate the will. If you are the sole surviving heir, you can deed the house to yourself. You only would need further legal process, ie: probate, if a title company requires it when you try to get a mortgage on the house. Cost is approximately $275-$350.

I am assuming your father had a will and left the house to you. Have you started probate yet? Have you received letters testament. from Surrogate court? If all is done and all you need is a new deed it will cost under $500. The estate must be probated and letters testamentary issued. The executor (you) can then deed the house to you. You would then want to record the deed. If the estate has not been probated, get a trust and estates attorney to handle it as soon as possible. You can call me at 212-367-9167 to discuss this further.
