Legal Question in Real Estate Law in New York

When my husband wants to take his ex-wife's name off the mortgage do we need to re-mortgage the house or is there a way to keep the same mortgage. She does not pay towards that mortgage, but just her name is on it.

If her name is on the mortgage, then her name is on the deed. That should have been fixed as part of the divorce proceedings. I would notify the bank of the change in circumstances. There is no need to refinance the mortgage, but you need to address the status of the deed.
