Legal Question in Real Estate Law in New York
Are we involved in a scam?
My husband and I recently broke a 2 year lease because we HAD to move out. The building manager states that we must continue to pay the rent until a new tenant moves in. We moved Oct. 1st and we're suppose to pay rent for October and so on. Also, they want to raise the rent for the new tenant. Therefore, they want us to pay the new raised rent fee until they have a new tenant. On top of all this they are charging us $500.00 extra for painting the apartment. Is this all legal or are we getting scammed?

Re: Are we involved in a scam?
Your obligations are determined by the terms of your lease. The landlord cannot charge you for a higher rent that a new tenant might pay - in fact, if the market rent for a new tenant is higher than that under your lease, you may be able to avoid the remaining liability of your lease altogether. Provide more details and a copy of your lease to an attorney to find out exactly where you stand.

some parts make sense others do not...I would consult an attorney in the Bronx.
