Re: judge
Generally, the judge will give total credence to the Referee's recommendation however the final answer and decision rests squarely with him or her (the judge). They can affirm or deny the Referee's recommendation based upon their own review of the facts and have in many a case been known to set aside a Referee's findings in favor of their own judgment. It is however unusual for them to do it if the Referee has been dilligent in reaching their conclusions in the case.
