Land boundary agreement

I subdivided my current property about a year ago. The surveyor recommended that boundary agreements be made due to old fence lines being moved or non-existing and noted this on the map. Now I have started building on the ''new'' property The title ins. co. wants the agreements to be made. So, an agreement was sent to the adjacent owners about 3 months ago and 1 still has not signed! I met with him about 3 weeks ago to look over the survey map and property lines and yet no response! I can not obtain a mortgage due to this and time is running out fast! What re-course do I have? The property owner verbally agreed to the lines of the new property but hasn't bothered to sign the agreement.
