Legal Question in Real Estate Law in New York

land transfer within family

my uncle died with no spouse or children. his properties were signed over to his two sisters, one of which is my mother. an agreement was drawn up before his death ''selling'' the property to them and the survivors of the parents had to sign and agree to the transfer. these survivors included not only the brother and two sisters but also the survivors of two deceased sisters. it sounds like the property must stay in the family unless agreed upon by these people. my question is, can the property be equally divided between the sisters and then be transfered to me and my children? also can the provisions be changed by the new owners?

Re: land transfer within family

Hi:

This is something that you should speak with an attorney about who would have to review the documents.

That being said, if all of the remaining parties are in an agreement, then a new document would have to be drawn together with a new deed dully executed by the survivors, and recorded in the Clerk's office.

I am available for a counsult at no charge to discuss this matter further.

Good Luck
