Legal Question in Real Estate Law in New York

Landlord breaking lease prior to move in date

Do we have the right to move in even though the landlord refuses, but a lease was signed. Do we have a case? Can we go to a small claim court without landlord providing the fact that we have a copy of the signed lease? Can a judge give us a ''injunctive action'' in a small claim court?

Re: Landlord breaking lease prior to move in date

It all depends on what your lease states and what actions have been taken by the parties. If your lease is valid, a landlord cannot limit your access to the property. I would recommend that you see an attorney and have him/her read your lease to determine what your rights are.
