Legal Question in Real Estate Law in New York

landlord fees

I gave my landlord notice that i was moving in the beginning in july. after a week in the month i cancelled b/c i told my landlord that i was buying a home and would not be moving yet. the landlord placed an ad in the paper to rent the apartment out which cost $57.00. the landlord wants me to repay the 57.00 to them. Would it be my responsibilty to pay that back?

Re: landlord fees

Why make an issue over $57 dollars. If you can afford a house, pay him the $. Would you rather have him give you a 30 day notice to get out and then spend 10X that on a lawyer?

Use common sense.

Good Luck

Re: landlord fees

Your notice of termination caused him to place the ad. When you revoked this, it became your responsibility. Even if it was not your responsibility, if you want to keep a good relationship and preserve your right to stay until you need to move, it is worth this charge. Think what it would cost if he gave you notice to move and you had to find a new location, possibly place your furniture in storage, etc.
