Legal Question in Real Estate Law in New York

Landlord Selling - How much time to move

Landlord is selling building in which we rent an apartment. New owners request us to leave within 3 months to renovate. We have a 3-year-old child. What is the maximum amount of time we can take to move under the law?

Re: Landlord Selling - How much time to move

If you wish to lengthen your stay you may have upto six months after a court order to vacate.

The Landlord first has to serve u a 30 day notice

then take you to court, If you demand trial and lose the judge still has an option to grant you 6 additional months at that time b4 ordering you to leave

If you have a lease the action cannot be commenced until the lease is over.

If you continue rent payments you can continue in possession until the court orders otherwise.

Contact an attorney to negotiate for you if you wish to stay longer than three months.

Good Luck.
