Legal Question in Real Estate Law in New York
What can I do in a landlord vs. tenant holdover case?
My family owns a 2 family house, we rented the 1st floor to a family, whose lease expired in august of 2000 it has almost been a year since their lease has expired. I gave them a one month notice that they couldn't renew their lease. When that month was over they didn't move, so we took them to court. Our attorney settled the case, saying that they had to move by 8/31 they agreed and signed the settlement papers. Now the attorneys called us up and said that the 1st floor is refusing to move and we need to go back to court. What can i do? is there an easier way out please help!! asap.

If the tenants refuse to move, you must go to court to have the agreement enforced by a judge.
