Legal Question in Real Estate Law in New York
Landlord told us to ''get out''
First, we moved in to two apartment home not knowing there was only one meter for both apartments and the landlord told us since our apartment was bigger he would just split the bill 1/3, 2/3 and we would get the 2/3. Is this legal? Next we argued and when we told him we would not pay it that way we wanted two seperate meters he exploded demanding that we move out. ''I want you out, when can you be out?'' Does this terminate our lease? We hope so. e is a nightmare.

Re: Landlord told us to ''get out''
Your lease should express the division of the utilities on the shared meter. However, if the lease is silent you can contact the appropriate utility company and have them provide you with an estimate of your portion of the bill. Most companies will require a visit out to the property and this service is usually free, but contact your local service provider. If both parties (Tenant and Landlord) wish to terminate the lease then you may. Just to protect your rights I would suggest that the termination of the lease be put in writing and signed by both Landlord and Tenant to prevent future claims of a lease breach.
