Legal Question in Real Estate Law in New York
Landlord will not return security deposit after vacating; gives no accounting
My two sons moved out of a 3 bedroom apt in a 2-apartment home in Brooklyn (The landlord and his family live in the other apartment.)after living there one year. My sons did no damage other than normal wear and tear. After 30 days passed, one of my sons called the landlord and left his new address and phone number; he has not been contacted by the landlord. Following that a certified letter (return receipt requested) was sent (signed by my sons) requesting that the security deposit be sent to a certain address; the green card was returned but the landlord has not responded. How do my sons get their security deposit back? Are they entitled to damages at this point?
