Laws regarding new leases

I have recently signed a lease for a new apartment after putting down all the money that I was required to take the apartment off the market. After signing the lease, the leasing office called to inform me that the current tenant is not moving out, and I was offered a much smaller apartment, on a lower floor. Having already signed the lease, is there anything that I can argue legally that the building would have to uphold?

Re: Laws regarding new leases

most leases have a clause that relates to the landlords inability to give posession review your lease. If it is not there you might have a claim but your damages would not seem to be great
