Legal Question in Real Estate Law in New York

lawyer will not release escrow

My aunt sold her house, found out she had a violation, lawyer holds on to $2,000.00. Has violation cleared by City of New York Dept. of Trans., lawyer not satisfied by decision of City, says he will contact the city, and then contact me 2 weeks have elapse. i walk into his office am accused of just walking in off the street by his wife, insists i make an appointment to see him. I feel that since the city has found the repairs satisfactory, then the money should me returned to my aunt asap, why is he stalling and making it difficult and insisting on an appointment, just to tell me whether the city has reapproved the approval???

Re: lawyer will not release escrow

Mishandling escrow funds is a very serious violation of an attorney's legal and ethical obligations. You should have another attorney send strongly-worded correspondence demanding immediate release of the funds. Feel free to all me at 212-367-9167 if you would like me to review the matter. I do not charge a fee for the initial consultation and I am confident that, assuming you've accurately described the situation, it would be fairly easy to compel the attorney to disgorge the funds.
