Legal Question in Real Estate Law in New York
She left it two years ago. Is it still hers?
I was dating a girl two years ago. She was living in an apartment with two roommates. Then she moved out. I was no longer her boyfriend when she moved out. She moved back home. She either asked me or I offered her space in my apartment for three boxes containing some of her belongings. We agreed or told each other that she would pick up her stuff once she moved out of her parents and into a place of her own. That was two years ago. At least one year ago she moved into an apartment of her own. I�ve contacted her via telephone about three or four times during the past five months requesting she retrieve her belongs. She told me she wants to pick up her stuff but she keeps canceling on the �pick-up� date. Can I throw her stuff out? Can she take me to court and win if I get rid of her stuff? Was there ever a time when ownership transferred from her to me during the two years?

From a practical standpoint, can't you simply deliver her belongings to her new apartment or to her parent's place (thereby avoiding all of the aggrevation that goes along w/throwing things out or keeping them as your own w/concomitant worries that you'll face liability)? BTW: If you do deliver it, either bring a witness, who can testify as to what exactly was delivered, or have the recipient sign a receipt acknowledging receipt of the items.
