Most likely, yes. You'd have to speak to a lawyer, but as long as you don't violate the zoning and building codes, it should not be a problem. Many shops and even some apartments are basement-legal. On the other hand, you can't get an apartment (legally) or a public assembly license in a cellar. That may be the source of your perplexity.
