liable or not - that is the question!

In a rental situation should the would be tenant wire a deposit (not the full amount) into would be Landlords account. The landlord will not accept the terms but cannot return the deposit until she gaets back from China in 4 weeks. This is because of her banks policy that she must be present to wire funds.

Is this acceptable or would the landlord be ''accepting'' the agreement because she is not returning the monies in a tilmely manner?

If prospective landlord does not agree to prospective tenant's terms to lease, proposed attempt to "trick," "invade" landlord's privacy or account; and otherwise compel landlord to accept the tenant, could result in unanticipated legal penalties, to the prospective tenant.
