Legal Question in Real Estate Law in New York

lien on property

A lien was placed on my home during a lawsuit. Summary judgement was granted to me, but now it was taken to appeal. Can I have the lien removed from the title because I was granted Summary judgement? How do I have it removed?

Re: lien on property

In order to completely answer your question I would need to know more facts about your situation but here's the general rule.

If you obtain a Judgment Release Order from a judge then that would be sufficient to file with the Clerk's Office of the county inwhich the property sits unless a stay was granted on the appeal. In otherwords, you can file the Order unless another judge informs you that the order is not valid pending the results of the appeal.

If you have additional questions or which to provide more specific information to me feel free to contact me.

Good luck,
