lis pendens

how long does a lis pendens stay recorded before you can sell?

my contract stated that closing would take place 45 days from the signing of it. it has been over 100 days and the buyer never submitted and extension or an updated commitment. i lost a property i was interested in due to waiting. i no longer wish to sell but i am being told that the buyer is filing a lis pendens on my property. how long does it take to be recorded and how long does a lis pendens stay recorded before you can sell? can it be removed?

First, why not ask YOUR lawyer?

Second, you can sell even with the lis pendens by doing certain things.

Pursuant to CPLR 6513, "A notice of pendency shall be effective for a period of three years from the date of filing. Before expiration of a period or extended period, the court, upon motion of the plaintiff and upon such notice as it may require, for good cause shown, may grant an extension for a like additional period. An extension order shall be filed, recorded and indexed before expiration of the prior period."
