Legal Question in Real Estate Law in New York
I live in a garden apt in a coop in ny state, i have a mold report indicating that there are high levels of mold spores in the apt and the problem needs to be remediated (we cant even live there at present) , the only source of water has to be a below the floor or behing the wall problem, how can i get my coop to remediate the problem as is indicated by the mold inspection report--the same situation arose
3 years ago adn the whole subflooring etc had to be replaced and we had no where to live for 6 months, I alerted the board that there was a problem but they chose not to even respond- the director of the board when i asked her in passing- said "ventilate"-- i have had dehumidifier, air conditions and other drying items going constantly-- I think they are trying to say it is my problem--

If it can be shown that the mold/water damage originates from outside your unit, then I believe you may have a viable action against the co-op.
