Legal Question in Real Estate Law in New York

I live in NY but rented a vacation home in Maine and gave a 10% deposit on it. My wife and I are involved in a criminal court case, not as defendants but it involved our deceased daughter, and the presiding judge changed the court schedule which interfered with our vacation. We have to be there, so I gave the landlord a month's notice (all that we had) and explained the situation. She didn't really care and said if she re-rented we might get our deposit back. She never got it rented and plans on keeping our deposit. I would like to get it back.

Also, there was never any written contract or agreement regarding terms of this, only a deposit and promise of renting it.

Do I have a legal right to get my deposit back and can I do that from a different state?

Since she did not re-rent, you have little chance of recovery.
