Legal Question in Real Estate Law in New York

I live in ny state. Recently my next door neighbor installed fencing 6-8 inches onto our property. When I called the town zoning dept they said they can't handle property disputes. Our land was newly surveyed and both the survey and the stakes in the ground CLEARLY show our marks! How can we force our neighbor to take down his fencing?

You can either sell him the eight-inch strip of your land or retain an attorney to sue him for trespass and an order to move the fence.

I agree, but write him (certified mail) and ask that he remove and relocate it. If he refuses, Arnold has given you the options.
