Legal Question in Real Estate Law in New York
I live in New York state. There is a narrow strip of property (15ft) between my home and next door neighbor that is owned by a church behind our homes. It is an unused right of way to their property. It has been unpaved, grassed over and maintained by the neighbors as part of their property for over 20 years. Now the church has decided to open this right of way as a paved road again. This would be paved right to my fence and only 10 ft from my home. Do either of us have any recourse against this?

Your neighbor may have a claim to the property by way of adverse possession. He should consult with a local real estate attorney as soon as possible.
