Legal Question in Real Estate Law in New York

My mom owned a home and she died a few weeks ago, her name was the only name on the deed. The home still has a small mortgage on it. Do I have any legal right to this home, or do the bank own it.

It depends on whether or not she had a will and whether their are any siblings or a surviving spouse.

If you are her sole heir and there is no will, you own the house subject to the mortgage and any other debts of her estate.
