Legal Question in Real Estate Law in New York

Mortgage Payments By Mistake

Hello, Last year, I asked a friend of mine to pay my mortgage for one month and one month only. That month was June 2006. He did everything online and, by mistake, ended up paying 7 or 8 months instead of just one. Now he wants his money. I paid him back for June of last year, but now he wants the rest. I am not employed and I live elsewhere. He is the broker handling the rental of my condo. What can I do? What steps can he take against me? Thank you.--name removed--

Re: Mortgage Payments By Mistake

If your friend only paid for June 2006, how were July-March 2007 handled? Is the condo the property you live in? Is it the property he paid the mortgage on, or do you rent that out and own something else as well. Perhaps with more information, an attorney can better advise you. From wha you have said though, by agreement, either you owe the "friend/broker" or he made a gift of one month's rent. For the other months, you certainly appear to owe him a reimbursement. An attorney mihgt be able to help work out a repayment solution.
