mortgage satisfaction

my mortgage was just paid off who pays for the satisfaction of mortgage papers to be filed me or the mortgage holder? it has been 2 months since they cashed the check thanks in advance jim

You pay. In most agreements, no mortgagee ever pays fees.

Up here in Dutchess, the County Clerk in Poughkeepsie takes about 6-8 weeks to record such documents. And the return address on them determines whether they go to you, or to your attorney. I generally like to get them so that I can keep a copy in my files and then transmit the sat. to the client.

You are entitled to a satisfaction of the mortgage. Generally, the lender will try to charge you for preparation. It is a very easy form to fill in. If you prepare it, they must execute it and return it to you.

You pay to record it in the County Clerk's office. (A must , to remove the lien of the mortgage.)
