Legal Question in Real Estate Law in New York

Our neighbor owns a duplex next door. She has 2 existing driveways, one to her door, one to the tenants door. She has always known and acknowledged that the tenants existing driveway is on our property. Our neighbor plans on renovating the existing driveway, and we have asked her to move the driveway off our property. Our driveway is separate from hers. There appears to be room on her land to accommodate moving the driveway a few feet on to her property. I checked with our local town government, they have no ordinance for this issue. Wondered if we need to hire a lawyer if she redoes the driveway and purposefully leaves it on our land, also wonder if she can legally leave the driveway where it is.
