Legal Question in Real Estate Law in New York
My neighbor resides in Italy. She has a home in NY that she rents short term (2-7 days). I leave keys for the incoming tenants and collect the rental fee and security which is deposited by me into her bank account. Checks are made to the owner. The owner and tenants sign the rental agreements. The last set of tenants (two attorneys) breached the rental agreement and the owner kept the security and all the rental money though they left two days early claiming the house was uninhabitable due the the frig not working. ( owner has proof frig in working order) I just got notice that they are suing me in small claims for the state max of $3000 for not returning thier security and breach of contract. How is it possible that I have any standing to be sued?

As an agent for a disclosed principal, the plaintiff does not have a cause of action against you.
