Legal Question in Real Estate Law in New York

Noise in my apartment!

I live in apartment building, which is being converted into condominium, building has 262 units, my lease expires Oct 2007, but the sponsor is renovating many empty apartments, and the noise levle is unbearable from 9 A.M to 5 P.M. I was informed that this will continue until the fall of 2007. Can I legally back out from the lease, since my apartment is unlivable during the day. I am retired and have to leave my apartment for these hours.

Re: Noise in my apartment!

You could easily get out of your lease and you might be able to get compensation for having to leave early as damages for breach of contract. You should consult a local attorney who can bring suit for you up there if necessary.
