Legal Question in Real Estate Law in New York

Noisy neighbors

The situation is such: the downstairs neighbors have children that make an ungodly amount of noise. This includes constant screaming and running back in forth both in their apartment and in the mutual stairwell. Speaking to the people has thus far been useless, and the landlord only shrugs in response to our complaints. Is there any kind of legal recourse we have to address the noise issue?

Hi:

I am sorry for your situation. Constant noise in and of itself does not in and of itself constitute constructive eviction. Perhaps if you speak with other adjoining neighbors that are also adversly affected by this situation, in a group you might have more influence with the landlord.

Children and Noisemakers are synonyms!!!

So, you probably should forgo thinking about "legal recourse" and simply plan on moving to another apartment or complex, as soon as able, where there is better insulation and fewer or no children.
