Legal Question in Real Estate Law in New York
Do I just need a notary for a quitclaim ?
I have a quitclaim form to remove my father in law from the title of my house. I've signed it, he's signed it and we had it notorized. I'm sure I need to file it with someone to get his name off the title. Do I go to the county courthouse? And if so, who do I see?
THank you

You go to the Recorder of Deeds in the County Court House. Since there is no consideration expressed in the Deed, there may be some tax forms to be attached to the Deed, but no transfer taxes should be due. The Recorder should be able to help you complete the forms and file the Deed. Alternatively, if you go back to the title company that recoreded the original Deed, for a small cost they should be able to help you also.
Re: Do I just need a notary for a quitclaim ?
You will need the Deed, a trasfer tax form/credit line mortgage certif called a TP 584 and a Real Property transfer form called an RP 5217 and a check for filing fee aprox $89 and to file it w/ Land Records/Deeds in county where property is located. (No sure if they'll take personal check). Email me if you need more info.

Go to the County Clerk's office in the county where the property is located. They will give you the forms you need.

As the other attorneys mentioned, the deed must be recorded, which requires several other "transfer documents". You need to do it right, because quitclaim deeds and deeds for no consideration will raise a red flag when you try to sell or refinance. If you have any trouble doing this on your own, or if you just want someone to look over the papers before you file them, call me at 212-367-9167.
