Does a nys sales tax lien on your home get paid first if your home is foreclosed by the bank ?

Probably not - unless recorded prior to the mortgage.

A tax warrant is a legal action against you and creates a lien against your real and personal property. Property tax liens would be paid first, NYS sales tax lien, then the actual mortgage balance owed would be paid from any remaining money left after the sale.
