Legal Question in Real Estate Law in New York

Obligation for landlored to renew lease.

As a landlord in Brooklyn,NY, if a lease is up are we obligated to renew?

What are our rights?

The tenant has been here for several years but the leases in the building are on a per year basis.

Re: Obligation for landlored to renew lease.

if the lease itself does not self-renew, you are under no obligation to consider the tenant after the lease expires.

Re: Obligation for landlored to renew lease.

Unless it is rent stablized or rent controlled you are under no obligations to renew. However, you must serve the tenant with proper notice of such and if it seems that they will not vacate voluntarily, it would be extremelyu advisable to have the notice drawn up by an experienced attorney that would likely thereafter need to file eviction proceedings on your behalf. We have substantial experience handling these types of cases, however, we would need some more information before making a complete and proper determination.
