Legal Question in Real Estate Law in New York
Ownership of house
I purchased a home 10 years ago with the father of my children whose name appears on the deed. He moved out 6 months after living there but continues to keep his name on the deed. I have since then paid the house off( i had my uncle pay cash and i paid him back) we had a notery stamp a paper saying we both have to pay it back. I am the only one who did, as well as the taxes and home owners ins. He is resisting signing off, what do i do to get him off?

Re: Ownership of house
I suggest retaining a good matrimonial and real estate attorney, as this will require litigation to clear title by having his name removed from the Deed. You will need proof of your payment of the Mortgage (which it appears you have), that the money which came from your uncle was a loan, not a gift, that you repaid him in full, that the father paid nothing towards all the bills, and probably more documentation that your lawyer will advise you to obtain. You do not say if you are receiving child support, which may be part of your claim. This is a response to an Internet question and the reply is not intended to be legal advice or as creating an attorney client relationship. Omitted or missing facts could change the response.
