Ownership of retaining wall

My property abuts the Mamaroneck River. According to my deed and a survey I have, I own up to but not including the retaining wall next to the river. The fence on the retaining wall was destroyed in a flood. The village says I own it and must replace it. Is that true?

It has been a while since I look at this type of issue, but I don't think you own it if you don't have it on your deed and you haven't been claiming it. If you did decide to repair it, I would get the village to deed it over to you so you at least will really own it...unless that is something you don't want.
