Legal Question in Real Estate Law in New York

owning house

when i was 18 my parents bought a house. my parents agreed that when i turned 21 the house would be transferred in my name because my father said that at 18 a house couldn't be put in my name. i am 22 and the house isn't in my name. my father has now decided that he no longer wants the house in my name but wants part of the house to go to children from his previous marriage. is their anything that my mother can do?

Re: owning house

The answer depends how the house is titled (owned) between your father and mother. A mere promise to transfer the house creates no rights to you. If the house is owned both by your father and mother, your mother's rights will depend on how the registration reads on the Deed. She may be able to transfer her share to you, or she may not have the right to do this without approval from your father. I would need to see a copy of the Deed to provide a better answer.

Re: owning house

It depends on what the terms of the agreement between your mom and dad were, and whether the agreement was was in writing. Why would your parents have wanted to purchase the house for you? Where did the money to buy it come from? If you don't have a claim against the house, some of these other details may give you other recourse. Good luck.

Re: owning house

More facts are required to properly answer your question. However, absent some writing by your stepfather setting forth the understanding that you would get the house at 21, or the bulk of the funds coming from your mother, you have an uphill battle.

Your mother may wish to deed to you her interest in the house.
