Legal Question in Real Estate Law in New York

Posted Signs

My question is concerning the use of posted signs. We have not always gotten along well with the neighbor who lives to the left of us. There is an inground pool area located in the back of our yard and our fence lies almost on the property line. It is a gray chain link. Our neighbor also has a fence that is mesh which lines the back of our fence. When weed wacking along the back of the fence, which is still my property, I had to step on his. This enraged the neighbor who proceeded to put up posted signs along each of his fence posts creating an unsightly view in my small back yard. My question is what can be done about this? The signs lie right on the property line. When I proceeded to take one down, which I know is illegal he called the police after using foul language in front of my young children in the pool. When the extremely unprofessional officer came he threatened to arrest me without even knowing where the property line was. What are my options? Are the signs necessary if there is already TWO fences? Shouldnt they be well on his property? Another detail i should include is that his house is not located behind mine his field is which is unused. The house is very far away.

Thank you for your time.

Re: Posted Signs

You indicate you initiated the problem by stepping on his fence. You do not say if any damage was involved, which if there was, it was caused by you. I would suggest checking if there are any local Ordinances regarding placement of fences and signs. If there are, are both you and your neighbor in compliance? If not, there may be some recourse. I also suggest checking if your Town has a Neighborhood Dispute Resolution Committee (as many Towns do) which provides an informal, but non-binding, means of mediation of these types of complaints between neighbors. If so, use this forum to try to resolve the dispute.
