If you have sub-let the Apt. by verbal agreement, 30 day notice is appropriate followed by a conventional holdover. If this is a roommate/shared occupancy situation, a licensee proceeding (with 10 day notice) is more proper. Depending on location, the paperwork must be precise (NYC Civil Ct, esp. Brooklyn is merciless with pro se landlords)so make sure service and forms are in order and that you have your proofs for trial.

Assuming not married:

Notice of termination (probably 30 days) composed and served properly

Wait for proper time period then goto court to have pro-se attorney draft eviction papers against sub-tenant, serve those and go see judge.
