Legal Question in Real Estate Law in New York

Private Drive

I live in a home on a private drive. Can my neighbor park his trailer(that he uses for his home based lawn/tree buisness)on the street?I am trying to prove he runs a buisness by taking photos as requested by town officials. Will the photos be submissable in court?I need any information on private drives possible so I'm aware of my rights.

Re: Private Drive

You should check with your municipal clerk, council or other governing body on whether there exists any local ordinances effecting this. Many communities have ordinances limiting parking overnight in streets, maximum size of permitted vehicles in driveways and whether vehicles, if permitted, can contain advertising on them. These ordinances usually have fines if violated. If there are no ordinances, go to a council meeting and recommend they adopt some. If there are existing ordinances, your photos are admissable if you appear as a witness (so the right to cross-examination is met). Contact your local police also. If there are violations, tickets can be issued and charges filed. It seems the request by your local officials may have started the ball rolling.
