Legal Question in Real Estate Law in New York
Can my property be auctioned off if the deed is in my name and the mortgage was in my deceased husband's alone? Aren't they supposed to sue the estate?

The mortgage company is a secured creditor and all they need to do is file suit against the person and serve the administrator of the estate.
