Property Damage after Bad Weather
After evening of 50 m.p.h. winds during Hurricane Wilma, tree from Neighbor #1's yard falls diagonally into Neighbor #2's yard and has landed on top Neighbor #2's fallen tree in #2's yard and below the two trees is a crushed children swing set that was in #2's yard.
No one saw the trees fall, don't know if #2's tree fell down on its own, blown down by the winds during the night or if it was knocked down by tree from #1's yard when it fell.
What is the liability of Neighbor #1 and Neighbor #2 with regard to their respective trees, each other and the swing set?
