property dispute between non-married cohabitants
A man and woman engaged to be married purchased a home together. The wedding was called off and the engagement was ended by the woman, who moved out of the home. The man remains in the home, and will not agree to sell the house. The man and the woman are each paying one half of the monthly mortgage. What recourse does the woman have to dissolve the "partnership" and remove herself from the mortgage obligation?

She needs to commence a partition action which would likely compel the sale of the residence and payoff of the mortgage.
