Legal Question in Real Estate Law in New York

Property Dispute

We purchashed our home 6 years through foreclosure. The mother of the forclosed lives next door. She rents the house next to us in which our property line goes almost to their door. The neighbors are horrible and like to harrass. My question is how close can we put a fence up off our line and how high can it be. Also, is there anyway to have the tenants evicted?

Thanks.

Re: Property Dispute

Your fence can usually go right on the property line with the better side facing the neighbors. Usually the fance can be 6 foot high with a permit or variance. Call your town/village planning board to ask.

You cannot have the tenants vevicted directly but call the sherriff/police each time there is a disturbance and establish a pattern of nuisance. This may set the stage for soemthing later.

Good Luck
