Legal Question in Real Estate Law in New York

We are purchasing a house from my husband's brother. He has taken the house over from the woman who use to own it, but it is now in his name. She did not pay the mortgage or taxes for 2 years and the banks are going through the foreclosure process. We are having the house appraised this week and going through the closing process ASAP. My quesiton is, how do we go about getting this woman out of the house? Do we need to give her an eviction notice? How much time, legally, do we have to give her to get out? What are the laws regarding this?

You do not have to give the occupant any time to get out. But why in heaven's name did your brother in law buy this house and not get possession? This looks like a "mortgage rescue" gone bad and I would engage an attorney before spending another penny on this disaster.
