Legal Question in Real Estate Law in New York

Putting my home in my childrens name.

My home is in my daughters & my name. (Mortgage & Deed) I want to turn my half over to my son, or my daughter, in case something happens to me, everything will already be in their names. I will continue to pay mortgage.

It can be done but technically, that is a breach of the mortgage. The lender, if they find out, will be permitted to call the Note.

A new deed will have to be prepared conveying your interest to your son.

You should also get the permission of the mortgage lender, but that should not be a problem.
